Agreement to these terms

These Terms of Service (“Terms”) apply to your use of bullandbuilt.com and to any services you buy from Bull & Built (“Bull & Built,” “we,” “us” or “our”). By using our website, submitting a form or buying our services, you agree to these Terms. If you are agreeing on behalf of a business, you confirm you have the authority to do so.

Our services

Bull & Built provides websites, search engine optimization (SEO), generative engine optimization (GEO), Google Business Profile setup and management, Google Ads and Meta ads management, social media posting, CRM and automation setup, estimates tools, logo design, business card design and related marketing services. What is included in your service depends on the package, website option or add-on you choose, as described on our pricing page or in your written quote.

Pricing, payments and billing

• Setup fees and one-time builds are due before work begins unless we agree otherwise in writing.
• Monthly fees are billed on a recurring basis to the payment method on file until your service ends.
• Growth packages (Foundation, Built and Bull) require a 3-month minimum agreement. Monthly fees for the minimum term are owed even if you stop using the services early.
• Website-only builds (Starter, Pro and Premium) are a one-time build fee plus $50 per month for website hosting.
• Business card printing is billed separately based on the quantity you order.
• If a payment fails or is late, we may pause your services, including ads and hosting, until your account is current.
• Prices may change. Changes will not affect any amount already agreed to in writing.

By giving us a payment method, you authorize us to charge it for the fees you have agreed to.

Advertising spend

Ad spend is not included in our fees. You pay Google, Meta or other ad platforms directly for your advertising. The Built package requires a minimum ad spend of $1,000 per month (about $33 per day), and the Bull package requires a minimum ad spend of $1,500 per month (about $50 per day). Ad platforms set their own prices, rules and approval policies, and may reject or limit ads at their discretion.

No guaranteed results

We work hard to grow your business, but marketing results depend on many things outside our control, including your market, competition, pricing, reviews, ad platform changes, search engine updates and how quickly you respond to leads. Any lead numbers, rankings or results described on our website or in our conversations are estimates and goals, not guarantees. We do not guarantee any specific number of leads, calls, customers, sales, search rankings or placement in AI search results.

Your responsibilities

To deliver your services, you agree to:

• Provide accurate business information, logos, photos, licenses and other content in a timely way
• Give us the access we need to your domain, Google, Meta and other accounts
• Review and approve work within a reasonable time
• Make sure the content you give us is yours to use and does not violate anyone else’s rights or the law
• Respond to the leads we send you

Delays in getting us what we need may delay your project. We are not responsible for delays caused by missing content, access or approvals.

Website ownership

Once your build fee is paid in full, you own your website’s design and content created for you. This does not include third-party software, platforms, plugins, fonts, stock images or tools, which remain subject to their own licenses and terms. Hosting is a separate monthly service. If hosting ends, we will work with you in good faith to help move your website.

Until the build fee is paid in full, all work remains the property of Bull & Built.

Use of your work in our portfolio

Unless you tell us otherwise in writing, you allow us to show the website and marketing we create for you, along with your business name and logo, in our portfolio, on our website and in our marketing.

Third-party platforms

Our services rely on third-party platforms such as Google, Meta, website hosting providers and our CRM provider. We are not responsible for outages, policy changes, account suspensions, price changes or other actions by these platforms. You are responsible for following each platform’s terms.

Text message (SMS) terms

By giving us your mobile number and opting in, you agree to receive text messages from Bull & Built about your inquiry, appointments, quotes, projects and our services. Message frequency varies. Message and data rates may apply. Reply STOP to opt out at any time, or HELP for help. You can also contact us at (720) 300-3227 or [email protected]. Carriers are not liable for delayed or undelivered messages. Consent to receive texts is not a condition of buying any service. See our Privacy Policy for how we handle your information.

Cancellation

After your minimum term, you may cancel your monthly services by contacting us in writing. Your services will continue through the end of your current billing period, and you will not be charged after that. One-time fees for work already started are not refundable. We may end services if you break these Terms or do not pay, and any unpaid amounts remain due.

Our content

The content on bullandbuilt.com, including our text, graphics, logo and designs, belongs to Bull & Built. You may not copy or reuse it without our written permission.

Limitation of liability

To the fullest extent allowed by law, Bull & Built is not liable for any indirect, incidental, special or consequential damages, including lost profits, lost revenue or lost data. Our total liability for any claim related to our services will not exceed the amount you paid us for those services in the three months before the claim.

Our website and services are provided “as is” without warranties of any kind, except those that cannot be excluded by law.

Indemnification

You agree to defend and hold Bull & Built harmless from claims that arise from the content you provide, your products or services, your business practices, or your breach of these Terms.

Governing law

These Terms are governed by the laws of the State of Colorado, without regard to its conflict of law rules. Any dispute will be handled in the state or federal courts located in Colorado, unless we both agree to another way of resolving it.

Changes to these terms

We may update these Terms from time to time. When we do, we will change the effective date at the top of this page. Your continued use of our website or services means you accept the updated Terms.
